A U.S. District judge ruled the U.S. Department of Agriculture exceeded its authority in its final rule to amend the Horse Protection Act. Four of the five provisions contested were granted summary judgments. The four provisions are the prohibition of action devices and pads, the prohibition of substances, the dermatologic conditions indicative of soring, and the pre- and post-deprivation review of inspector decisions. The court upholds the HPA’s designated qualified persons program.
